Terms and Conditions
1. Introduction and Acceptance
These Terms and Conditions of Service (“Terms”) constitute a legally binding agreement between you (“User”, “Trader”, or “you”) and Savius Software Consulting FZCO (Dubai Silicon Oasis, Dubai, UAE), Savius Trading Firm SL (Av. Lucio Diaz Flores Feo, 20, 38639 San Miguel de Abona, Santa Cruz de Tenerife, Spain), and any affiliated entities (collectively “Savius”, “we”, “us”, or “the Company”).
By accessing, registering for, or using any Savius website, platform, product, or service (collectively the “Services”), you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, you must not access or use the Services.
These Terms apply to all users of the Services, including visitors, registered users, challenge participants, and funded account holders.
2. User Eligibility
To use the Services, you must satisfy all of the following requirements at the time of registration and at all times during your use of the Services:
- You must be at least 18 years of age, or the legal age of majority in your jurisdiction, whichever is greater.
- You must have the full legal capacity to enter into binding contracts under applicable law.
- You must not have been convicted of a felony or any criminal offence involving financial crime, fraud, market manipulation, or dishonesty in any jurisdiction.
- You must not have been disciplined, suspended, barred, or sanctioned by any financial regulatory authority in any jurisdiction, including but not limited to the U.S. National Futures Association (NFA), the U.S. Commodity Futures Trading Commission (CFTC), the European Securities and Markets Authority (ESMA), the UK Financial Conduct Authority (FCA), or Spain’s Comision Nacional del Mercado de Valores (CNMV).
- You must not be listed on any sanctions list, including the OFAC Specially Designated Nationals and Blocked Persons List or equivalent lists in any jurisdiction.
- You must not have an outstanding unpaid balance with any prop trading firm.
- You must not simultaneously be a partner, director, shareholder, employee, or collaborator of any other proprietary trading firm or competing financial services company.
- Your use of the Services must comply with all applicable laws and regulations in your jurisdiction.
By using the Services, you represent and warrant that you meet all eligibility requirements above. Savius reserves the right to verify eligibility at any time and to terminate accounts where eligibility requirements are not met or cease to be met.
3. Account Registration and Security
You must provide accurate, complete, and current information at the time of registration. You are responsible for keeping your account information up to date.
Your account is strictly personal and non-transferable. You are prohibited from:
- Sharing your username, password, or account credentials with any third party.
- Allowing any other person to access or trade on your account.
- Registering more than one account, including through different email addresses, household members, or third parties.
- Combining or transferring account performance, data, or parameters with any other user or account.
You must notify Savius immediately at info@savius.com if you suspect any unauthorised access to or use of your account.
Savius reserves the right to verify your identity at any time, including by requiring a video call identification. When a trader’s payout is under review via a verification call, the trader is forbidden to trade on their account until an official email from the compliance team with the verification outcome is provided.
Use of the Services under a false name or on behalf of another person is strictly prohibited and will result in immediate account termination and forfeiture of all pending payouts.
Each account on Savius systems is strictly personal and non-transferable. Traders are prohibited from sharing access to their account, login credentials, trading platforms, or IP addresses with any other Savius user or third party. Where our monitoring systems detect that two or more distinct user accounts are operating from the same IP address, device, or network environment without prior written disclosure and approval from Savius, this will be treated as a presumptive indicator of account sharing, collusion, or unauthorized copy trading. Upon detection, Savius reserves the right to immediately suspend all associated challenges, deny any pending or future payout requests, and permanently terminate the accounts involved. Traders who share a household or physical workspace with another Savius user must notify info@savius.com in advance and may be subject to enhanced monitoring. Failure to disclose such circumstances will be considered a violation of these Terms.
Savius may disable or terminate any account at its sole discretion, at any time, for any reason, including without limitation for suspected breach of these Terms, without prior notice and without liability.
4. Description of Services
Savius provides trader evaluation programs, simulated trading environments, instant funding accounts, and related educational and analytical tools. The specific features, parameters, and conditions of each product are described on the Savius website and may be updated from time to time.
All trading conducted through Savius accounts is simulated unless Savius expressly notifies you in writing that you have been transitioned to a live account. Simulated trading does not involve real money. Any funds referenced in a simulated environment are fictitious and confer no right of ownership or withdrawal.
Following satisfactory performance across payout cycles, at Savius’s sole discretion, a trader may be transitioned to a live account with adjusted risk parameters. This transition is entirely at Savius’s discretion and creates no contractual obligation on Savius’s part.
4.1 Account States
Products held under your user account may at any time be in one of the following states: (a) Active — enabled for trading, with any applicable evaluation period running; (b) Inactive — purchased but not yet activated; the evaluation period has not started; (c) Pending Funded Activation — an evaluation has been passed and the resulting funded account is awaiting activation under the funded-account limits published on the Savius website; (d) Expired — the product’s activation window under Section 4.3 or 4.4 has lapsed, its evaluation period has ended, or the product has been terminated or deactivated pursuant to these Terms. The numeric limits, parameters, and activation mechanics applicable to each product and state are described on the Savius website and dashboard and may be updated from time to time.
4.2 Active Evaluation Limit
The number of Timed Evaluations that may be simultaneously Active under a single user account is limited to the maximum published on the Savius website from time to time (currently twenty (20)) (the “Active Evaluation Limit”). The Active Evaluation Limit is an account-level limit: the value in force at any given time applies to your user account as a whole, regardless of when the individual evaluations were purchased. If the published Active Evaluation Limit is reduced, evaluations that are already Active are not affected; however, no further evaluations may be activated for as long as the number of your Active evaluations equals or exceeds the limit then in force. Purchases in excess of the Active Evaluation Limit are accepted and held as Inactive: they are not enabled for trading and their evaluation period does not begin until activation.
4.3 Activation Window for Purchased Evaluations
Each purchased Timed Evaluation must be activated within ninety (90) days of the date of purchase (the “Activation Window”). A Timed Evaluation that is not activated by the end of its Activation Window expires automatically and is forfeited without refund, credit, or replacement, in accordance with Section 6. The expiry date of each purchased evaluation is displayed at checkout and on your dashboard, and Savius will send reminder notifications to the email address associated with your user account before expiry; non-receipt of a reminder does not extend the Activation Window, and the expiry date shown on your dashboard is authoritative. It is your responsibility to manage your purchases so that each can be activated within its Activation Window; Savius does not extend Activation Windows on the ground that you elected to hold purchases in reserve.
4.4 Pending Funded Activation Window
Where you pass a Timed Evaluation and the resulting funded account is not immediately activated — whether because no funded slot is available under the funded-account limits published on the Savius website, or for any other reason — the resulting funded account is placed in Pending Funded Activation. A funded account in Pending Funded Activation must be activated within ninety (90) days of the date on which the evaluation was passed; this period runs from the pass date in every case, regardless of whether, when, or for how long a funded slot is or becomes available. A funded account in Pending Funded Activation that is not activated within this period expires automatically and is forfeited without refund, credit, or replacement, in accordance with Section 6. The applicable expiry date is displayed on your dashboard, and Savius will send reminder notifications before expiry; non-receipt of a reminder does not extend the period. Activation of a funded account in Pending Funded Activation is free of charge.
5. Fees, Payments, and Subscriptions
All fees for Savius products are displayed on the website at the time of purchase and are subject to change without notice.
The data feed subscription renews monthly on the first day of each calendar month. The first month’s subscription is included in the initial account purchase. Data feed subscriptions that are activated or renewed part-way through a calendar month expire at the end of that same month; no partial refunds are available for unused periods.
All payments are processed through authorised third-party payment processors. Savius does not store credit or debit card information directly. You are responsible for ensuring that payment information provided is accurate and authorised.
Service fees are inclusive of applicable taxes where required by law. You are solely responsible for any additional tax obligations arising from your use of the Services in your jurisdiction.
6. Refund Policy
All purchases are final and non-refundable. Upon completing a purchase, your trading account is created and the data feed is immediately activated. Savius considers the service rendered in full upon granting access to the platform.
No refunds will be issued under any circumstances, including but not limited to:
- Failure to pass a challenge or evaluation.
- Voluntary cancellation of an account.
- Account termination due to rule violations.
- Unused data feed periods within a calendar month.
- Technical issues outside Savius’s reasonable control.
In the event that Savius revokes a stated offer or corrects a pricing error after payment has been accepted, Savius will issue the appropriate credit within a reasonable time.
7. Chargeback and Dispute Policy
If you initiate a chargeback, dispute, or reversal request with your bank, payment provider, or card issuer in connection with any payment made to Savius, you will be immediately and permanently banned from all Savius services. All pending payouts, account balances, and accrued profits will be forfeited.
If you have a genuine concern about a payment, you must contact Savius directly at info@savius.com before initiating any third-party dispute process. Savius will investigate and respond to legitimate complaints within 21 days.
8. Trading Rules and Prohibited Practices
8.1 General
All trading activity on Savius accounts must reflect genuine, commercially reasonable trading behaviour consistent with how trading is actually performed in the applicable live markets. Trading strategies that exploit the simulated environment, circumvent evaluation rules, or generate profits not achievable in live market conditions are strictly prohibited.
8.2 Prohibited trading practices
The following activities are strictly prohibited on all Savius accounts, whether challenge, funded demo, or live:
- High-frequency trading (HFT) or tick scalping.
- Spoofing, layering, or any form of order book manipulation.
- Hedging positions across multiple Savius accounts or between Savius accounts and accounts held at other firms.
- Copy trading, signal following, or group trading that involves replicating trades from or to external accounts.
- Flipping, defined as opening and closing a position with the sole purpose of triggering a trading day, showing significant deviation from the trader’s demonstrated trading style (e.g. holding time, frequency, lot sizing).
- Copy trading between Savius accounts belonging to different account categories, for example between a Savius Evaluation account (whether during the Timed Evaluation or in its funded phase) and an Instant Funded account. Copy trading between a user’s own Savius accounts is permitted only between accounts of the same category (for example, between Instant Funded accounts), within the account limits set out in these Terms.
- Using Expert Advisors (EAs), trading bots, automated trading systems (ATS), artificial intelligence tools, or any automated software for trading purposes. Multiple users using the same trading bot or ATS is also strictly prohibited.
- Trading using an external, delayed, or non-standard data feed.
- Executing trades outside the best bid or offer.
- Taking advantage of errors, latency, or price discrepancies in the platform.
- Engaging in reckless or gambling-type trading behaviour, including excessive leverage or unrealistic position sizes relative to account norms.
- Trading on behalf of another person, or sharing profits or incentives with third parties as part of any business arrangement.
- Combining or pooling trading activity across multiple unconnected accounts with the intent of hedging aggregate risk.
- Trading within 2% of an exchange-imposed price limit.
- Performing an unrealistic number of contracts in a single day, or achieving single-trade profits that are inconsistent with genuine trading.
8.3 System, Product and Account Configuration Errors
For the purposes of these Terms, a “Configuration Error” means any apparent technical or administrative error or inconsistency affecting a Savius account, product or service, including an incorrect account type, starting balance, drawdown or loss limit, position limit, payout cap or profit split, trading-day requirement, rule set, entitlement, duplicate credit, or other account parameter.
If a User knows, or in the circumstances reasonably should know, that a Configuration Error exists, the User must stop relying on the affected setting and notify Savius without undue delay and, where reasonably practicable, within 24 hours of discovery. The User must not knowingly exploit, conceal, repeat, facilitate, or encourage the use of a Configuration Error to obtain an account or benefit, avoid a rule, or increase eligibility for profits or payouts.
Savius may suspend the affected account while it investigates and may correct the account so that it reflects the product and parameters to which the User was entitled. Where Savius establishes on objective evidence that the User knowingly and materially exploited or concealed a Configuration Error, Savius may void benefits or profits directly attributable to that error, withhold or deny the affected payout, or close the affected account. Deliberate, material, or repeated misconduct may result in termination of other accounts or a permanent ban.
Savius will provide the User with the material basis for its decision in writing. Prompt reporting in good faith, and use occurring before the User knew or reasonably should have known of the Configuration Error, will not by itself constitute a violation. Unaffected accounts and payouts will not be forfeited unless they are subject to a separate violation of these Terms.
8.4 Consequences of violations
If Savius determines, in its sole discretion, that a User has violated any trading rule or engaged in any prohibited practice, Savius may take any or all of the following actions without prior notice:
- Remove or disqualify trades that violate the rules from the account’s trading history.
- Void profits generated through prohibited activity.
- Reset, suspend, or permanently close the account.
- Forfeit all pending payouts and accrued profits.
- Ban the User from all Savius services permanently.
Savius reserves the right to determine, at its sole discretion, whether any trading practice constitutes prohibited conduct.
9. Account Management Rights
Savius retains full discretion over the management of all trading accounts. Without limiting the foregoing, Savius reserves the right to:
- Monitor all trades executed on demo and live accounts.
- Replicate trades on a master account or balance positions independently.
- Enter hedging trades at its discretion.
- Modify account parameters, risk settings, position limits, or product access at any time.
- Impose trading restrictions or suspend trading on any account where Savius determines that a trader’s activity presents excessive risk, is incompatible with normal market operations, or is inconsistent with Savius’s risk management policies.
- Transfer a trader to a live account with adjusted parameters following satisfactory performance.
- Permanently close any demo or live account where trading practices are deemed inconsistent with the company’s risk management standards or strategic objectives.
These rights may be exercised at any time, with or without notice, and without liability to the User.
10. Profit Share and Payouts
Profit share requests may be submitted at any time, subject to the parameters, minimum amounts, and conditions specified on the Savius website. Savius reserves the right to update payout terms at any time.
Savius reserves the right to audit any trader’s activity prior to processing a payout. Savius may invalidate any trades that fall outside the rules established in these Terms, the Savius website, or the Savius dashboard.
Profit share payments will not be made in respect of:
- Trades executed in violation of these Terms or Savius’s trading rules.
- Profits generated through prohibited trading practices.
- Accounts that are under investigation for rule violations.
- Accounts where a chargeback has been initiated.
The profit share percentages applicable to each account type are set out on the Savius website and are subject to change. Following the first payout cycle, profit share rates and account parameters may be adjusted at Savius’s discretion based on a review of the trader’s performance.
11. Amendments to These Terms
Savius reserves the right to amend, modify, replace, or update these Terms at any time and in its sole and absolute discretion. Changes will take effect immediately upon posting to the Savius website or upon notification to the User, whichever occurs first. No advance notice is required.
Your continued use of the Services following any amendment constitutes your acceptance of the revised Terms. If you do not wish to be bound by the amended Terms, you must cease using the Services immediately.
Savius also reserves the right to modify the rules applicable to any trading account at any time, for internal or external reasons. Existing accounts may retain their original parameters only at Savius’s express discretion.
12. Intellectual Property
All content, technology, software, tools, trademarks, logos, and materials on the Savius platform are the exclusive property of Savius or its licensors and are protected by applicable intellectual property laws. You are granted a personal, non-exclusive, non-transferable, revocable licence to access and use the Services solely for your personal, non-commercial use.
You must not reproduce, distribute, modify, reverse engineer, sell, sublicense, or create derivative works from any part of the Services without Savius’s prior written consent. You must not use Savius trademarks or branding in any manner without express written permission.
13. Data, Monitoring, and Privacy
By using the Services, you grant Savius an irrevocable, worldwide, royalty-free right to access, monitor, record, analyse, and share your trading data and account information with its affiliates and partners for risk management, business, and regulatory purposes. This right is exercised automatically and requires no further consent from you.
Personal data is collected and processed in accordance with Savius’s Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to such processing.
14. Network, Device, and Travel Compliance
14.1 IP and Device Monitoring Disclosure
Savius logs and analyses IP addresses, device identifiers (including MAC addresses where available), geolocation data, and network signals associated with all access to the Services. The stated purpose of this monitoring is to verify that each Account is operated exclusively by its registered owner, to detect account sharing and collusion, and to prevent fraud. Such logs are retained for up to ten (10) years following Account closure, for fraud-prevention, dispute-resolution, and enforcement purposes. By using the Services, the User acknowledges and consents to such collection, processing, and retention. This clause supplements §13 and the Privacy Policy referenced therein.
14.2 VPN, VPS, Proxy, and IP-Masking Tools
The use of a VPN, VPS, proxy, Apple Private Relay, or any other IP-masking technology is tolerated provided that the User notifies compliance@savius.com in advance, specifying: (a) the provider used; (b) the exit country; and (c) the expected duration of use.
Undisclosed use of any such tool will result in:
(a) enhanced identity verification before the processing of any pending or future Profit Share payment; and
(b) a presumption of Account sharing, collusion, or unauthorised copy trading under §3 (Account Registration and Security), with the consequences set out therein.
14.3 Travel Notification Requirement
Users who intend to access or trade on the Services from any country other than their registered country of residence must notify compliance@savius.com in advance of departure, providing: (a) the dates of travel; (b) the destination country; and (c) the connection method intended (home ISP, mobile hotspot, hotel Wi-Fi, VPN/VPS, or similar).
Users must also retain documentary evidence of the trip (boarding pass, passport stamp, hotel or accommodation booking, or equivalent) for the entire duration of the journey and for a minimum of ninety (90) days thereafter. Savius reserves the right to request such evidence at any time, including by scheduling a verification call. The User must produce the requested documentation within ten (10) business days of the request.
Failure to communicate travel in advance will be treated as a compliance breach and will automatically result in:
(i) flagging of the Account as a suspected shared Account under §3;
(ii) immediate suspension of the Account pending review;
(iii) denial of any pending Profit Share payout, including payouts already requested but not yet processed;
(iv) application of the sanctions set out in §3 (Account Sharing), up to and including permanent termination of the Account.
Production of valid travel evidence after the fact does not automatically reverse these measures. Reinstatement remains at the sole discretion of Savius Compliance, following case-by-case review.
15. General Prohibited Uses
In addition to the trading-specific prohibitions in Section 8, you agree not to use the Services to:
- Violate any applicable law, regulation, or third-party right.
- Impersonate any person or entity, or misrepresent your identity or affiliation.
- Transmit spam, unsolicited advertising, or malicious code.
- Attempt to gain unauthorised access to any part of the platform or its infrastructure.
- Scrape, harvest, or automatically extract data from the platform.
- Use the platform for any commercial purpose not expressly authorised by Savius.
- Make false, defamatory, or misleading statements about Savius, its products, or its staff on any platform, review site, or social media channel.
Violation of this section may result in immediate account termination and, where appropriate, legal action.
16. Regulatory Disclaimers
Savius is not registered as a broker-dealer, investment adviser, commodity trading adviser, or in any other regulated capacity with the U.S. Securities and Exchange Commission (SEC), the CFTC, the NFA, the FCA, ESMA, or any other regulatory authority. The services provided by Savius do not constitute investment advice, financial advice, or commodity trading advice. No employee, representative, or affiliate of Savius is authorised to provide investment recommendations. Any statement that could be interpreted as investment advice is expressly disclaimed.
CFTC Rule 4.41 — Hypothetical or simulated performance results have certain inherent limitations. Unlike an actual performance record, simulated results do not represent actual trading. Because trades have not actually been executed, results may have under- or over-compensated for the impact of certain market factors such as lack of liquidity. Simulated trading programmes are also subject to the fact that they are designed with the benefit of hindsight. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown.
17. Disclaimer of Warranties
The services are provided strictly on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, Savius expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Savius does not warrant that the platform will be uninterrupted, error-free, or free of harmful components, or that any defects will be corrected. Use of the services is entirely at your own risk.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Savius, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or related to your use of or inability to use the services.
In no event shall Savius’s total liability to you for any claim of any kind, whether based in contract, tort, strict liability, or any other theory, exceed the greater of: (a) the total fees paid by you to Savius in the one calendar month immediately preceding the event giving rise to the claim; or (b) EUR 100.
This limitation applies regardless of whether Savius has been advised of the possibility of such damages and to the fullest extent permitted by law.
19. Indemnification
You agree to indemnify, defend, and hold harmless Savius, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Services; (b) your breach of these Terms; (c) your violation of any applicable law or regulation; (d) your violation of any third-party right; or (e) any trading activity conducted through your account.
20. Waiver of Class Action Rights
To the fullest extent permitted by applicable law, you waive any right to bring or participate in any class action, collective action, or representative proceeding against Savius. All disputes must be brought on an individual basis only. This waiver applies to all claims and disputes of any nature.
21. Dispute Resolution and Governing Law
21.1 Amicable resolution
Before initiating any formal legal proceedings, you agree to first contact Savius at info@savius.com with a written description of your complaint. Savius will endeavour to resolve the complaint within 21 days of receipt.
21.2 Arbitration
If the dispute cannot be resolved amicably within 30 days of the initial complaint, either party may submit the dispute to binding arbitration. The arbitration shall be conducted in English, under the rules of a mutually agreed arbitration body, applying the laws of the jurisdiction in which the Company is registered. The seat of arbitration shall be the place where the Owner is based, as disclosed in the relevant section of this document. The arbitrator’s decision shall be final and binding on both parties.
21.3 Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the Company is registered, without regard to conflict of laws principles. Subject to the arbitration clause above, the exclusive jurisdiction for any legal proceedings shall lie with the courts of the place where the Owner is based, as disclosed in the relevant section of this document.
21.4 European and UK consumer rights
Nothing in these Terms affects the statutory rights of Users who qualify as consumers under applicable law. In particular, Users who qualify as consumers in the European Union, the United Kingdom, Switzerland, Norway, or Iceland retain all rights afforded to them under the laws of their country of residence, including the right to bring claims before competent courts in that country. Where the law of the User’s country provides for higher consumer protection standards than these Terms, such higher standards shall prevail.
21.5 Time limit for claims
Any claim arising out of or relating to these Terms must be brought within one (1) year of the date on which the cause of action accrued. Claims not brought within this period are permanently barred.
22. Termination
Savius may suspend or terminate your access to all or part of the Services at any time, for any reason or no reason, with or without notice, and without liability. Reasons for termination include but are not limited to: breach of these Terms, suspected fraudulent activity, regulatory requirements, or business decisions.
Upon termination, all licences granted to you cease immediately. Any pending payouts may be forfeited if termination results from a violation of these Terms. Provisions of these Terms that by their nature should survive termination (including Sections 6, 7, 12, 13, 16, 17, 18, 19, and 20) shall survive termination.
23. General Provisions
23.1 Entire agreement
These Terms, together with the Privacy Policy and any supplemental agreements, constitute the entire agreement between you and Savius regarding the Services and supersede all prior agreements, representations, and understandings.
23.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
23.3 No waiver
Savius’s failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
23.4 Assignment
Savius may assign or transfer its rights and obligations under these Terms at any time without notice. You may not assign your rights or obligations without Savius’s prior written consent.
23.5 Force majeure
Savius shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, pandemic, regulatory action, infrastructure failure, or market closure.
23.6 No partnership or agency
Nothing in these Terms creates a partnership, joint venture, employment relationship, or agency between you and Savius. Neither party has authority to bind the other.
23.7 Contact
All notices, complaints, and communications should be directed to: info@savius.com
